The purpose of this agreement is to stipulate the rights, obligations and responsibilities, and other necessary matters between the Korea Tourism Organization’s VISITKOREA website/mobile application service (hereinafter referred to as “VISITKOREA) and the subject of personal location information (hereinafter to referred to as ”User”) in terms of the location-based services provided by VISITKOREA.
Matters not specified herein shall comply with the Act on the Protection and Use of Location Information, Act on Promotion of Information and Communications Network Utilization and Information Protection, Framework Act on Telecommunications, Telecommunications Business Act and other relevant regulations, terms of use and privacy policy of VISITKOREA, and other guidelines as set forth by VISITKOREA.
① VISITKOREA tracks User’s location information to provide the following location-based services:
1. Nearby information: Provides tourist information/local information and related content around the current location
2. Directions: Navigational information from the current location to a selected destination
3. Access information: Country and city information is tracked based on User’s GPS and IP address information. The tracked data is used for VISITKOREA’s user statistics and target marketing. User can refuse this data tracking by rejecting “functional cookies” in the cookie settings.
4. Welcome/Farewell Information: Sends an entry/exit guidance message from the VISITKOREA mobile application when located at major international entry/exit locations. * Only applies to users with the VISITKOREA mobile app installed on their mobile device.
② Provision of location-based service and tracking of personal information by VISITKOREA serves the following purpose.

① VISITKOREA tracks User’s location information using the following methods:
1. Tracking of real-time location information based on the base station (Cell ID method) of User’s mobile phone terminal
2. Tracking of location information based on the IP address connected to the server
② VISITKOREA only tracks location information and does not collect tracked data.
① The User may defer his/her consent for part of the scope of the track of personal location information and the terms of use, or the usage and purpose of personal location information, scope of the recipient of personal location information, and part of location-based services.
② Any User may fully or partially withdraw their consent to the track, use and provision of personal location information.
③ Any User may request, at any time, a temporary suspension on the track, use and provision of personal location information. In such case, VISITKOREA shall not refuse such request and shall take technical measures accordingly.
④ Any User may request VISITKOREA to permit them to inspect any of the following data or to give notice of any of the following data, and may request VISITKOREA to correct an error found in the concerned data. In such case, VISITKOREA shall not reject such request without good cause:
1. Data verifying the track, use and provision of personal location information which relates to the User;
2. The ground on which the personal location information of the User was provided to a third party pursuant to the provisions of the Act on the Protection and use of Location Information or other Acts and the relevant details.
⑤ Where the User fully or partially withdraws their consent, VISITKOREA shall, without delay, destroy the tracked personal location information and the data verifying the track, use and provision of location information. Notwithstanding the foregoing, where the User partially withdraws their consent, such destruction of data is limited to the personal location information and the data verifying the use and provision of location information for the part withdrawn.
① When providing services based on personal location information, VISITKOREA shall announce such information in the Terms of Use and obtain consent from the User before the provision of said services.
② The rights of User or his/her legal representative(s) and the method of exercising the rights are governed by the address of the User at the time of filing the complaint. If the address is missing or unavailable, the complaint will be under the exclusive jurisdiction of the district court of the User’s place of residence. If the User resides aboard, the complaint shall be brought to the competent court under the Civil Procedure Act.
③ VISITKOREA shall automatically record and retain data confirming the use and provision of location information in order to process complaints made by other business operators or users for a period of six months.
④ In case VISITKOREA provides personal location information to a third party designated by the User, VISITKOREA shall immediately notify the User of the recipient of such information, the date, time, and purpose on each occasion of such provision via the communication terminal device from which the personal location information was tracked. However, notice shall be provided via communications device or email address specified in advance by the User in any one of the following circumstances:
1. If the communications device tracked through the personal location information is not capable of receiving text messages, voice messages, or video messages.
2. If the User has requested in advance to be notified via other means such as online announcement
① Where it becomes impossible for VISITKOREA to maintain its services due to various circumstances of VISITKOREA such as policy changes of the location-based service provider or legal obstacles, VISITKOREA may restrict, change or terminate the service fully or partially.
② When the service is terminated pursuant to paragraph (1), VISITKOREA shall make an announcement on the Internet or notify the User prior to such termination.
Where a User suffers damage because VISITKOREA has violated Articles 15 through 26 of the Act on the Protection and Use of Location Information, he/she may claim damages against VISITKOREA. In such cases, VISITKOREA shall not be exempt from liabilities unless it proves that there was no intention or negligence on its part.
