Special Tourist Zone

Introduction

The term "special tourist zone" means an area designated as one exempted or granted leniency from regulations under any statute related to tourism activities and in which it is required to apply endeavors to develop an environment for tourism, such as services, information systems, and public relations, relating to tourism activities in order to facilitate the attraction of foreign tourists under Article 2 (11) of the Tourism Promotion Act.

Designation of Special Tourist Zones

Special tourist zones shall be designated by the Mayor/Do Governor at the requests of the head of a City/County/District (excluding cases of the Special Self-Governing Province), from among areas that satisfy all the requirements in the followings:

The number of foreign tourists shall reach or exceed the quota prescribed by Presidential Decree;

There shall be facilities for tourist information facilities, public facilities, accommodations, etc. to meet the demands of foreign tourists, as prescribed by Ordinance of the Ministry of Culture, Sports and Tourism; and

The ratio of land that has no direct connection with tourist activities, such as woodlands, farmland, industrial area, and housing lots, shall not exceed the guideline prescribed by Presidential Decree.

Requirements for Designation of Special Tourist Zone

The number of foreign tourists during the preceding one year in the relevant area should be 100 thousand persons (or 500 thousand persons for Seoul Special Metropolitan City) according to the statistics announced by an institution specialized in statistics that meet the guidelines publicly notified by the Minister of Culture, Sports and Tourism.

The ratio of the area of land that has no direct connection with tourist activities, such as woodland, farmland, industrial area, and housing lots, to total area of a special tourist zone should be less than 10 percent.

There shall be facilities for tourist information, public convenience, accommodation, etc. to meet the demands of foreign tourists as follows.

  • Tourist information center, interpretation center, tourist signs

Accommodations
  • Tourist hotel, floating tourist hotel, traditional Korean hotel, family hotel, tourist condominium
  • At least 1 lodging establishment available for the criteria for registration of tourism businesses
Sports & Recreation Facilities
  • Folk village, beach, game reserve, zoo, botanical garden, aquarium, hot spring resort, cave, swimming pool, agricultural or fishing village resort facilities, forest resort facilities, museum, art gallery, gliding club, car campsite, tourist excursion ship, general amusement complex
  • At least 2 establishments among tourist-use facilities available for the criteria for registration of tourism businesses and amusement facilities that have facilities and equipment prescribed by Ordinance of the Ministry of Culture, Sports and Tourism
Entertainment Facilities
  • Tourist theater, tourist entertainment restaurant, tourist theatre entertainment, entertainment restaurant, tourist restaurant
  • Tourist-use facilities available for the criteria for registration of tourism businesses or tourist convenience facilities available for the requirements for designation of tourist convenience facilities and enough to meet the demands of tourists
Shopping facilities
  • Department store, conventional market, duty-free shop
  • At least 1 establishment

Investment Incentives

The State or a local government may render support necessary for promotion of a special tourist zone, including improvements of facilities for convenience in activities of foreign tourists who visit special tourist zones.

Financial Support
  • The Minister of Culture, Sports and Tourism may lend money or give subsidies from the Tourism Promotion and Development Fund under the Tourism Promotion and Development Fund Act for such cultural, sports, lodging, and commercial facilities within a special tourist zone, which are deemed particularly necessary for attracting tourists in order to facilitate convenience in activities of foreign tourists who visit special tourist zones.

Special Cases under other Acts
  • Article 43 of the Food Sanitation Act concerning restrictions on business shall not apply to special tourist zones.
  • A person who runs a hotel business within a special tourist zone may provide public performances and food for foreign tourists at an open area (open space), as prescribed by ordinance of the relevant local government, for up to 60 days annually.
  • The head of a local government having jurisdiction over the special tourist zone shall request the commissioner of the competent district police agency or the chief of the competent police station to take measures prohibiting or restricting the use of the relevant road by motor vehicles or horses.
  • Article 74 of the Act
