VISITKOREA Location-based Service Terms of Use and Privacy Policy for Location Information Establishment
In accordance with the Act on the Protection and Use of Location Information, Act on Promotion of Information and Communications Network Utilization and Information Protection, Framework Act on Telecommunications, Telecommunications Business Act and other relevant regulations, the Korea Tourism Organization is implementing the following location-based service terms of use and privacy policy for location information for the VISITKOREA website/mobile application service. The Location-based Service Terms of Use and Privacy Policy for Location Information will go into effect starting June 27, 2025. VISITKOREA Location-based Service Terms of Use Article 1 (Purpose) The purpose of this agreement is to stipulate the rights, obligations and responsibilities, and other necessary matters between the Korea Tourism Organization (hereinafter referred to as the “Company”) and the individual who has agreed to the Terms of Use of personal location information (hereinafter to referred to as the ”User”) in terms of the location-based services (hereinafter referred to as the “Services”) provided by VISITKOREA. Article 2 (Effects and Modifications of Terms of Use) ① These Terms of Use take effect upon User’s agreement and registration to the Services stated by the Terms of Use hereof. ② By clicking or tapping the “I Agree” button of this page, the User shall be deemed to have read and fully understood the Terms of Use and agreed to the application thereof. ③ The Company has the right, if necessary, to revise the Terms of Use to the extent that it does not violate laws and regulations relevant to the Services, such as the Content Industry Promotion Act, Act on the Consumer Protection in Electronic Commerce, and Framework Act on Consumers. ④ If revision is made to the Terms of Use, the Company shall notify the Users with the date of revision, purpose, original Terms, revised Terms, and effective date along with a statement informing that unless the User expresses their refusal to the revision, it shall be deemed that the User has agreed to the amendment. The Company shall notify the User in the following manner: 1. Announce on the website connected to the Services: announcement shall be made 30 days prior to the date the amendment takes effect and remain announced until deemed necessary (or until next revision) 2. Notify registered Users individually in electronic form (email, etc.): users shall be notified 30 days prior to the date the amendment takes effect Article 3 (Application of Relevant Laws) The terms hereof are applied in good faith in accordance with the relevant laws, and any matters not specified shall be governed by the aforementioned laws. Article 4 (Description of Services) ① The Company offers location-based services and collects personal information for purposes and duration stated below. ② The Company shall automatically record and retain the data verifying the use and provision of location information in accordance with Article 16 (2) of Act on the Protection and Use of Location Information. Service Name Purpose and Use of Location-based Information Duration of Use of Personal Location Information VISITKOREA Location-based Service o Recommend nearby attractions based on User’s location o Recommend nearby ongoing events based on User’s location o Send notifications if User is within major arrival and departure areas in South Korea Until the withdrawal of User’s consent to provide location-based information * Location information is processed for one-time use only and is not stored on the server ③ The Company shall destroy User’s personal location information, excluding the data verifying the use and provision of location information, upon achieving the intended purpose pertaining to ② of these Terms of Use. Provided, that this may be delayed for one year from where the retention of such User’s location information is mandatory by other statutes or regulations, or the User has agreed on a separate notice. Article 5 (Fee for Using the Services) ① The service provided by the Company is free of charge. ② Data communication fees incurred when using wireless services are separate and are subject to the policies of each mobile carrier the User is subscribed to. Article 6 (Notifying Changes in Services) ① In the case the Company changes or terminates its terms of services, the Company shall notify the User through the website. ② Pertaining to ①, the Company shall notify to anonymous users of the changes through the website. Article 7 (Restriction and Suspension of Services) ① The Company may restrict or suspend the User from using the Services under any one of the following cases: 1. Where the User has interfered with the Company’s operation or services intentionally or by gross negligence; 2. Where it is unavoidable due to maintenance or reconstruction of service facilities; 3. In the event the telecommunications business defined under the Telecommunications Business Act has suspended or terminated telecommunications services; 4. Where the service cannot be maintained due to obstacles in the provision of services such as a national emergency, hindrance in service facilities, or congestion in usage; or, 5. In the event the Company deems it is inappropriate to continue to provide the Services due to other serious reasons not specified above. ② In the event the Company restricts or suspends the Services due to any one of the reasons above, the Company shall notify the User of the reason and the period of time through the website and in electronic form (email, etc.). ③ If the Company is unable to announce or notify the User due to unavoidable circumstances in accordance with the paragraph above, the Company may notify the User after the restriction or suspension of services. Article 8 (Use and Provision of Services) ① When providing services based on personal location information, the Company shall announce such information in the Terms of Use and obtain consent from the User before the provision of said services. ② In the event the Company provides the User’s location information to a third party designated by the Company, the Company shall notify the User of the recipient and its purpose before disclosing the information. ③ In the event the Company provides personal location information to a third party designated by the Company in accordance with ② of this Article, the Company shall immediately notify the User of the recipient, the date, time, and purpose (herein after “details of information provision”) on each occasion of such provision via the telecommunications device that collected the personal location information or email. ④ However, in the event of any of the following cases, notification shall be sent to the telecommunications device, email address, or via online notice as pre-specified by the User: 1. Where the User’s telecommunications device that collected the location information does not have the required features to receive text, voice, or video; or, 2. Where the User has requested in advance to be notified through a pre-designated means of communication, such as a telecommunications device other than the one used to collect location information or email address. ⑤ Notwithstanding ③ in this Article, pursuant to Article 24 of the Enforcement Decree of the Act on the Protection and Use of Location Information, the User can choose to be notified of the details of information provision at once after collecting them to be notified immediately according to the paragraph thereof. ⑥ If the User consents to Paragraphs ①, ②, and ⑤, they may reserve their consent on the notification of the provision and purpose of information, the scope of recipient, certain parts of the Location-based Information Terms of Use, and deciding on the notification method in the case of providing the information to a third party. Subsequently, consent must be obtained from the subject of personal location information. Article 9 (Restrictions on Use or Provision of Location Information) The Company shall not use or provide to a third party the User’s location information or the data verifying the use and provision of location information outside the scope stated in these Terms of Use without the User’s consent except for any one of the following: 1. If the data verifying the use and provision of location information is necessary to settle any fees that occurred from using location information services. 2. In the case where the information is provided in an encrypted form where the User remains anonymous for the purpose of data analysis, academic research, or marketing survey. Article 10 (User Rights and Execution) ① The User has the right to request partial or complete withdrawal from their agreement with the Company’s location-based Services and provision of their location information to a third party at any time. In the event the User withdraws from their agreement, the Company shall immediately destroy the collected location information and related data. However, in the case of partial withdrawal, it shall be limited to the User’s personal location information and the data verifying the use and provision of location information. ② The User has the right to request the Company to discontinue from collection, use, and disclosure of their location information at any time and the Company has no right to refuse user‘s request and must abide to the request. ③ The User has the right to request the Company to access or modify an error in any one of the following information and the Company has no right to refuse the user’s request without any justifiable reason: 1. Confirmed data of the User’s collection, use, and disclosure of location information data. 2. The purpose and information that was disclosed to third parties in pursuant to laws and regulations related to location information protection. ④ The User can claim their rights stated in ① and ③ in accordance with the Company’s procedure. Article 11 (Designated Personnel for Handling Location Information Data) ① The Company shall designate a location information data manager to be responsible for managing and protecting the User’s location information and handle complaints related to personal information. ② The location information data personnel is the head manager of the department, and details on the position follow the attachment on this Terms. Article 12 (Compensation of Damages) ① In the event the User incurs any damages as a result of the Company’s violation of Articles 15 through 26 of the Act on the Protection and Use of Location Information, the User may claim compensation for the damages against the Company. In such cases, VISITKOREA shall not be exempt from liability unless it can prove that there was no intentional misconduct or negligence on its part. ② In the event the Company incurs any damages as a result of the User’s violation of Terms of Use, the Company may claim compensation for the damages against the User. In such cases, the User shall not be exempt from liability unless it can prove that there was no intentional misconduct or negligence on their part. Article 13 (Court of Competent Jurisdiction) ① These Terms of Use shall be interpreted and governed by the laws of the Republic of Korea. ② The rights of the User or his/her legal representative(s) and the method of exercising the rights are governed by the address of the User at the time of filing the complaint. If the address is missing or unavailable, the complaint will be under the exclusive jurisdiction of the district court of the User’s place of residence. If the User resides aboard, the complaint shall be brought to the competent court under the Civil Procedure Act of Korea. Article 14 (Settlement of Disputes) ① In the event where a dispute between the User and the Company is not settled, the Company may file a petition to the Korea Communications Commission in accordance with Article 28 of Act on the Protection and Use of Location Information. ② In the event where a dispute between the User and the Company is not settled, the Company or the User may file a petition to the Dispute Mediation Committee in accordance with Article 43 of the Personal Information Protection Act. Methods and Procedures for Destroying Location Information 4. Provision of Location Information to a Third Party 5. Personnel and Department for Handling Location Information Data This Privacy Policy discloses how VISITKOREA protects your location information in accordance with Article 21-2 of Act on the Protection and Use of Location Information (hereinafter “Protection Act”) and relevant laws, for the purpose of providing a better understanding of your rights and facilitating the swift and convenient resolution of related disputes. 1. Purpose of Processing and the Retention Period of Location Information 1. Methods and Procedures for Destroying Location Information VISITKOREA shall immediately destroy your personal location information, excluding data verifying the use and provision of location information, upon achieving the intended purpose. 4. Provision of Location Information to a Third Party VISITKOREA shall not provide to a third party your location information or the data verifying the use and provision of location information outside the scope stated in the VISITKOREA Location-based Service Terms of Use without your consent, except in any one of the following cases: • Where the information is provided in an encrypted form where the User remains anonymous for the purpose of data analysis, academic research, or marketing survey. • Where it has been mandated by related laws 5. Notification of Service Pursuant to Article 19(3) of Act on the Protection and Use of Location Information • In the event VISITKOREA means to provide a service based on your location information, VISITKOREA must notify and receive your consent in advance. • In the event VISITKOREA discloses your location information to a third party, VISITKOREA must immediately notify you of the party involved, provision date, and purpose of providing location information. 6.
